Criminal Defense

Criminal Defense Putting Your Best Interests First

A high-caliber law firm offering legal expertise in criminal cases in Hamilton County, and throughout Southeast Tennessee.

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial by an impartial jury of the state and district in which the crime was committed. These are the rights guaranteed by the Sixth Amendment of our Constitution. Furthermore, the state must prove every element of a crime beyond a reasonable doubt in order to convict an accused, and may not impose excessive bail or cruel or unusual punishment.

At The CW Firm, we will not allow innocent clients to be strong-armed into a plea deal for a crime they didn't commit, nor will we allow our clients to suffer excessive criminal punishments for minor infractions. Everyone makes mistakes and everyone should be given the same mercy and grace that they would want to receive under the same circumstances. If this is the first time you have been charged with a crime, or if you have been wrongfully accused or are facing charges that far exceed the act committed, give us a call. We are here to help.

Are you facing criminal charges and need someone who knows how to get the best outcome for you? Contact The CW Firm today at 423-210-4411, or email us at contact@thecwfirm.com and let us help you reach a just and fair resolution.

Cases We Handle

Our Attorneys provide representation in all kinds of criminal cases throughout various courts in Southeast Tennessee.

In Tennessee, criminal charges are adjudicated in General Sessions and Criminal Circuit Courts. In Hamilton County, there is a General Sessions Court for the county as well as other Municipal Courts which also function as Sessions Courts for each of the respective cities. These courts include Red Bank Municipal Court, East Ridge Municipal Court, Soddy Daisy Municipal Court, and Collegedale Municipal Court. The CW Firm provides criminal representation in all Criminal Circuit Courts, Sessions Courts, and Municipal Courts throughout Southeast Tennessee, including Hamilton County, Bradley County, Marion County, Rhea County, McMinn County, Meigs County, and Sequatchie County.

If you have been criminally charged in Tennessee, your case will fall into one of two categories: misdemeanor crimes or felony crimes. If you have been charged with a misdemeanor crime such as simple assault, domestic assault, theft of property (if under $1,000), or simple possession of drugs or drug paraphernalia, your case will most likely be heard in one of the General Sessions Courts as described above. This is because General Sessions Court jurisdiction only allows these courts to resolve misdemeanor cases and provide for a preliminary hearing in felony cases. Attorneys at The CW Firm have experience before most of the Sessions Court Judges and Municipal Court Judges throughout Hamilton County and the surrounding counties, and are happy to help regardless of where your case starts.

Some felonies may start out in Sessions Court, but if you cannot resolve your felony charge either by dismissal or reducing it to a misdemeanor, then the only option you have is to have a preliminary hearing or bind the case over, either of which will result in your case going to the grand jury. If you have a felony charge that has been bound over from Sessions Court or if you have been indicted on felony charges in Criminal Circuit Court, we can help you. Our attorneys are extremely thorough and will comb through every piece of evidence in order to make the best case for you, whether it be through deliberations with the prosecutor or by arguing your case at trial before a jury.
